1. Overview

This Site and the Services are owned and operated by Phillip Worthy trading as Salty Sets (referred to in these terms as “Salty Sets”, “we”, “us”, and “our”).

Salty Sets offers a range of products and services that may be purchased individually or collectively, which include the following:

  • Framed and unframed photographic prints (printed to order)
  • Surf and ocean photography sessions (“Salty Sessions”)
  • Digital image files and photography packages
    • (collectively and individually, these are referred to as the “Services”).

By purchasing, accessing and using any or all of the Services, you agree to these terms and conditions (“Terms”).

Please read these Terms carefully before you purchase or otherwise access any of our Services. These Terms, along with our Privacy Policy (collectively “the Terms”), govern your access to https://www.saltysets.com, including the Services.

By accessing the Services, you:

  • acknowledge that you have read, and agree to comply with and be legally bound by, these Terms; and
  • warrant that you are over 18 years of age and have the legal capacity to enter into a binding contract.

We reserve the right to modify these Terms at any time, consistent with applicable laws and principles, without notice to you. These changes will be effective as of the date we post the revised version on this Site. It is your responsibility to review these Terms prior to initial use as well as periodically throughout your use of the Services. If at any time you choose not to accept these Terms, you should discontinue your use of our Services.

By continuing to access our Services, you are deemed to accept any future amendments to these Terms. If you are uncertain about the Terms or anything else on our Site, please don’t hesitate to contact us before completing any purchase.

2. Online Store Terms

You must be at least 18 years old (or have parental consent) to use this site or engage our services. You may not use our products or services for any illegal or unauthorised purpose.

Violation of any terms will result in immediate termination of your access to our Services.

3. Products and Availability

All photographic prints are handmade or printed to order. We do our best to display colours and details accurately, but we cannot guarantee that your monitor's display will perfectly represent the product's appearance.

We reserve the right to:

  • Limit quantities of prints available for sale.
  • Discontinue products at any time.
  • Update pricing or descriptions without prior notice.
  • Decline photography service bookings at our discretion.

4. Salty Sessions Photography Service

Salty Sessions is a professional surf and ocean photography service offered by Phillip Worthy through Salty Sets. Engagement of Salty Sessions is subject to a separate Photography Service Agreement, which will be provided to you at the time of booking and must be agreed to before any session takes place.

The following general terms apply to all photography bookings:

4.1 Bookings and Deposits

A booking is not confirmed until a deposit has been received and a Photography Service Agreement has been signed by both parties. The deposit amount and payment schedule will be outlined in the Agreement.

4.2 Session Conduct

Clients and participants are expected to follow all reasonable directions from the photographer during a session. Phillip Worthy reserves the right to cancel or end a session where safety concerns arise or conduct is deemed inappropriate, without liability for refund.

4.3 Deliverables

Delivery timelines, file formats, and the number of edited images will be specified in the Photography Service Agreement. Salty Sets does not guarantee specific outcomes, including particular waves, conditions, or weather during a session.

4.4 Cancellations and Rescheduling

Cancellation and rescheduling terms for photography sessions are governed by the Photography Service Agreement. In the event of unsafe surf or weather conditions, Salty Sets reserves the right to reschedule a session at no additional cost to the client.

4.5 Image Use and Model Release

By participating in a Salty Sessions photography session, participants grant Salty Sets and Phillip Worthy the right to use resulting images for portfolio, promotional, and social media purposes, unless a written opt-out is requested prior to the session. Full terms are detailed in the Photography Service Agreement.

5. Orders and Payment

When you place an order or booking, you agree to provide current, complete, and accurate purchase and account information.

All prices are listed in Australian Dollars (AUD) and include GST where applicable. Payment is required in full (or by deposit as specified) at the time of purchase or booking.

We accept major credit and debit cards, PayPal, and other payment methods as listed on our website at the time of purchase.

6. Shipping and Delivery (Prints)

Orders for photographic prints are typically placed into production within 1–2 business days of purchase. Delivery times may vary based on location and carrier availability.

We are not responsible for:

  • Delays caused by postal or courier services.
  • Import taxes, customs duties, or fees for international orders.
  • Damage during transit (though we will work with you to resolve any issues).

7. Returns and Refunds

As each print is made to order, we generally do not accept returns or exchanges unless the item is defective or damaged upon arrival.

If your order arrives damaged:

  • Contact us within 7 days of delivery.
  • Provide photos of the issue.
  • We will arrange a replacement or refund where appropriate.

Refund and cancellation terms for photography sessions are governed separately by the Photography Service Agreement.

8. Copyright and Intellectual Property

All photographs, designs, and written content on Salty Sets are the intellectual property of Phillip Worthy and are protected by Australian and international copyright laws.

You may not reproduce, distribute, or use any images or content without prior written permission.

Digital image files delivered as part of a Salty Sessions photography service are licensed for personal use only, unless a commercial licence is separately agreed to in writing. Clients may not sell, sublicence, or transfer images to third parties without express written consent from Phillip Worthy.

9. Limitation of Liability

Salty Sets and Phillip Worthy shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our products or services, to the maximum extent permitted by Australian law.

Participation in surf and ocean photography sessions involves inherent physical risk. By engaging Salty Sessions, clients and participants acknowledge and accept these risks. Nothing in these Terms limits liability for personal injury caused by negligence.

10. Privacy

Your submission of personal information through the store or booking forms is governed by our Privacy Policy. We use your information solely to process orders and bookings, deliver products and services, and improve your experience with Salty Sets.

11. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will take effect immediately upon being posted on this page. Continued use of the website or our services after changes are posted constitutes your acceptance of the updated Terms.
